Terms of service
These terms are an agreement between you and Furvur Inc. ("we"), a company organized under the laws of the Province of Ontario. We operate WaiverBee. "You" means the merchant who installs WaiverBee and the business that merchant represents.
By installing or using WaiverBee, you accept these terms. If you do not accept them, do not use WaiverBee.
The service
WaiverBee is a Shopify app. It lets you collect signed waivers, forms and agreements from your customers, and it stores the signed records for you. You need a Shopify store to use it, and Shopify's own terms also apply to your store.
Not legal advice
WaiverBee is software, not a law firm. Nothing in the app, on this website or in our support is legal advice.
We do not promise that any waiver, signature or record is valid or enforceable, or that it will protect you from a claim. That depends on your document, your activity, the signer and the law where you operate. Have a lawyer review your waiver.
Your responsibilities
- You are responsible for the content of your documents.
- You have the right to collect the information you ask signers for, and you have a lawful basis to do so.
- You give signers any notices the law requires, including your own privacy notice.
- You decide which signers may sign, including any rules for minors and guardians.
- You answer requests from your customers about their data.
- You keep your own copies of any records you must keep. See "Uninstall and deletion".
Acceptable use
Do not use WaiverBee to break the law, to mislead signers, to send spam, to upload malware, or to attack or overload the service. We limit how many emails a shop can send each day, and we may apply other limits to protect the service.
Plans and billing
Plans and prices are on the pricing page. The Free plan includes 5 signatures a month. Paid plans include a monthly number of signatures and charge a set rate for each extra signature.
- Billing is monthly, in US dollars, through Shopify. There are no annual plans.
- A signature counts once per signer per document. A returning signer whose waiver is still valid does not count again.
- Imported paper waivers do not count.
- We do not block signing because of billing. Extra signatures on a paid plan are charged at your plan's rate.
- Prices do not include taxes. Shopify may add tax to your bill.
- We will give you notice before a price change takes effect. If you do not accept it, uninstall before that date.
Your data
You own your documents and your signed records. You give us permission to host, process and send them only to run WaiverBee for you.
For the personal data of your signers, you are the controller and we are your processor. We process that data only to provide the service, on your instructions as set out in these terms, and as the law requires. Our privacy policy lists the data, our subprocessors and how long we keep each item. We use our subprocessors under the same limits, and we stay responsible for their work for you.
Signed records
A signed record cannot be edited. You can turn a document off, but you cannot delete a document that has signatures. This protects the record. Personal details in a record are removed when Shopify sends us a customer redaction request.
Automatic field detection
If you upload a PDF with no fillable form boxes, WaiverBee can send that PDF to an AI provider to suggest where fields go. Suggestions can be wrong. Check every field before you publish a document.
Uninstall and deletion
When you uninstall WaiverBee, we drop our access to your store. Shopify then sends us a shop redaction request, about 48 hours later. When it arrives, we erase your documents, signed records and uploads, unless you have reinstalled by then. This cannot be undone.
Export what you need before you uninstall. We do not keep a copy for you after the erasure.
Availability
We work to keep WaiverBee running, but we do not promise that it will always be available or free of errors. It depends on Shopify, Cloudflare and other providers. We may change or remove features.
Disclaimer
To the extent the law allows, WaiverBee is provided "as is", with no warranty of any kind, including any warranty of merchantability, fitness for a particular purpose or non-infringement.
Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost data or claims from your customers. Our total liability for all claims is limited to the amount you paid us for WaiverBee in the 12 months before the claim arose.
Indemnity
You will cover our reasonable losses from a third-party claim that arises from your documents, your dealings with your customers, or your breach of these terms.
Ending this agreement
You can stop at any time by uninstalling WaiverBee. We may suspend or end your use if you break these terms or if the law requires it. Where we reasonably can, we will tell you first.
Changes to these terms
We may update these terms. We will change the date at the top of this page. If a change is material, we will tell you before it takes effect. If you keep using WaiverBee after that, you accept the new terms.
Governing law
These terms are governed by the laws of the Province of Ontario. The courts of that place have jurisdiction over any dispute.
